Okay, it all comes down to this:
If we can garner enough signatures and speak during the citizen participation, we can offer the following:
Option 1: Call for the resignation of the BOS. I'm not sure how many signatures we would require, and of course, they will have to be verified. This is the civil thing to do. Present the signatures along with a petition requesting the resignation of the BOS. This would require a door to door canvas with a littany of the mistakes and overspending of the BOS.
Option 2: If they scoff at the resignation, then we proceed with a recall. When we do the canvas, we also explain that if they do not resign, we would like to consider the signatures for the recall election. At that time, we have already collected the signatures and presented the BOS with an option to resign.
Option 3: Let's face it, option 3 isn't pretty. There is strong sentiment that legal action is forthcoming on a number of fronts (which is part of the reasons we are even considering this). I think it is a good bet that the legal action will force a few resignations and or criminal charges.
I'm not worried about repercussions from the BOS or the TA, they are scrambling and looking to fortify a weak position. So many blunders can only lead to this type of action. Based on my last encounter with the one of the brood, they have no idea what they are about to face. I really believe they consider the voters and taxpayers well below them and not capable of unseating them. That in itself is an insult.

Slage is a meaningless pawn in the entire equation. He publishes a Middle School newspaper (at best), and reminds me of a mushroom (they keep him in the dark and feed him sh*t). I don't believe there is a person in town that reads his nonsense as news. Most people find it entertaining warbling of a immature pimple faced teenager.
As far as I am concerned, without the BOS, he will have nothing to write about and leave town soon after they are comfy in their cells, or ignored throughout town.

Slager can't call real people as sources. No one with any integrity will talk to him. So, he just makes it all up.
I agree with onlyinwareham. Is there someone out there who is willing to organize this? I can't do it for several reasons. But if something gets going, please post it on this site so the word can get out.
I know the good citizens of CBW have been treated badly by the bos and by ragboy, but if you all are planning something, please let the rest of us know. The line has been crossed and the bos and their mouthpiece can't go back to the safety of their little club and the anonymity of the executive session. True evil always exposes itself.

I will have a conversation with a couple of people. We have put off this conversation for various reasons, but I think it's time to just do it. I just want to be clear, this is business, not personal. I have my own personal battles going on with the BOS and their pet TA. Those battles will be resolved separate from this. As a taxpayer and resident of Wareham, I believe it is my duty to eliminate the problem and make this town a better place to live. We should be able to get enough signatures to make this stick, and if not, the people of Wareham only have themselves to blame.
I also want to state that the BOS and TA really do believe no one has the ability to take them down. This irks me even more. I cannot believe this group can even comprehend that there are intelligent people who can make them go away. This plays right into the hands of the good people of Wareham.

Maplesprings--clearly it is K and P who are advising these jokers. And K and P are the boot lickers of municipal law firms (in my opinion). That is well known. Since a K and P lawyer accompanied the computer geeks, they will have ok'd the process. That means that now they need to keep telling their clients that they won't be taken down. Can we prove them wrong?

Isn't it K & P that have asked to be released from their duties because the BOS is not following their advice? If that is the case, then who is advising them? I'm not a lawyer (thank god), but I would think that in this case, it appears even the lawyers are abandoning ship?
As far as the excecutive session, if they are hanging their hat on the previous weeks announcement of an executive session, then someone needs to go back and review the taped meeting. They must declare the session and the reason for the session. If they did not do this, they are in violation. PERIOD.

I think the letter to K and P was just a warning---like if you don't play nice, we will dump you as our clients. I was told that the lawyer during the seizure of hard drives was a K and P person.
Did they accept the minutes of the previous meeting? They would be in the public domain then, sometimes online. But if you could remember when they did this in the past, you could surely check out the previous minutes. I know it has happened before--pre open meeting exec. session--but don't have dates. I hadn't realized before that it was illegal.

Back to considering the options.....
This just an idea, but I would love the feedback.
What if we draft a petition stating we (the registered voters and taxpayers of Wareham) will no long accept the actions of the current BOS. We could go into detail of what we disagree with and ask for them to either support the will of the voters or resign. We take this petition around Wareham (multiple people going door to door) and get signatures and addresses. Let's set a limit of 10 days (two weekends for us working people) to walk around our neighborhoods. At the end of the 10 days, we see how many signatures we have. if it is significant and enough to support a possible recall, we elect a spokesperson to go the the BOS meeting and present the petition during citizen participation. We should be able to determine the response and it will be public, so there is no speculation. If we are met with arrogance and anger, then we know we can proceed with a recall.
This is all based on the number of supporters that sign the petition, and the reaction of the BOS. I think we will be able to obtain the necessary signatures and then it is easier to approach the BOS from a position of strength.
It's better to be prepared than to assume and end up with egg on our face.

I have a couple of questions for anyone who may possibly be able to answer them...
In regards to the library situation, if a settlement is reached prior to the results of the computer audit being made public, if anything is uncovered on the library computers because of the audit, (missing donations for example) can that info be released or would it also be sealed even though it's two separate actions?
If a recall is successful, does anything stop the current BOS members from running if they take out nomination papers and get the required signatures?
I am curious about your timing for this...don't you think you would find a lot more people willing to sign your papers and vote the current members out if you were to wait until the results of the audit are made public, assuming that the results validate the premise that the whole thing was just a witch hunt to find bloggers? Unless someone knows something they're not telling the rest of us...

If there are funds missing it can not be covered up. It would need to be reported to the Attorney General or the Ethics Commission or Public Charities. Because this BOS and Slager have a history of inferring or outright stating the ridiculous, I believe it not to be true. The BOS & Slager would love nothing better than to run full speed to the authorities if they thought there was money missing.
MapleSprings, there was a petition that went around with responsible persons appearing before the BOS. Jane said because the individuals didn't talk to her first, she would not pay attention to the petition. Bruce just tossed the petition aside saying that people told him they were pressured into signing it. He also said that most of the signatures came from people in bars..... they've got a story for everything.

I think the legal issues of the case will suppressed if they reach a settlement. Barring an anonymous source from Slager, there will likely be no information released as "both sides agreed to the settlement, financial terms of the settlement were not released".
This is not just about the audit, and if they were looking for evidence against the trustees, why did they make it town wide? Even if they come up with something from the library, they spent a great deal of money (wasted) to needlessly copy other department's computers. It would have to be earth shattering to stop me from calling it a waste of money.
The town charter states they cannot be a candidate to replace themself.
Let's be honest here Ms. Lilly, after Jane Donahue came out with her quoted comments in the Standard Times, there isn't much the BOS could say to stop me from feeling like they have no idea how to run a town. I think their ego and arrogance has taken them down a road with a dead-end. If you want to hang your hat on the audit, feel free to do that, but it's just another piece of the puzzle. I'm not willing to excuse the behavior or the mis-steps that seem to occur over and over again.
I am also curious how many people will sign the petition. I know of about 30 from my neighborhood, but there are far bigger areas and that is why it needs to be a team effort. As far as timing, I would hope the audit results are disclosed before we get too far in the process, but I don't expect anything to change the acrimony that is building.

This time, if we have enough signatures, we can go straight to the procedures for recall. I am hoping for over 3000 signatures and addresses of VOTERS. If we have that, they better stand up and listen! If they do not, then we have enough to begin the recall.
If we don't have the signatures, then we just drop it. It's as simple at that. It really comes down to people wanting change. If the majority says yes, we have the green light to go ahead.
They can say what they like or where the signatures were collected, but in the end, they will either pay attention or be recalled.

I want to make this clear (again), I have no desire to run for Selectmen. Between my job and current family activities, it would be impossible. I appreciate the the thought, but there are others who have the best intentions for Wareham and more time to spend. I just want to see the town mangement in the hands of capable people who don't have a personal agenda that requires town money to achieve!

MRM...I understand the audit is just a another piece of the puzzle regarding the recall effort, but it will be the one that will be the most recent on people's minds when the results of the audit are released and if it does uncover wrong doing before the recall process is complete, they will be hailed as heros and will sit on that board for as long as they decide they want to, regardless of any future wrongs you may or may not think they are guilting of committing...

Hate to tell you, but if they do find something that one of those agencies would be responsible for investigating... the evidence would be useless, because all criminal investigations for such matters would require a search warrant signed by a judge or magistrate.
Everyone has the same rights in the United States... the just, the criminal, and those damn rotten town employees

Would that still hold true if the information just happened to be discovered during a run of the mill, town wide computer search that had no particular town department targeted? Ya know, kind of like the way it seems like it happened? If that wouldn't be enough to fly legally, couldn't they just say they were looking for bloggers and just happened to come across the really good stuff completely by accident? Hey, didn't someone at the library say the selectmen's names were mentioned when asked what they were looking for? That's in print somewhere...one of Urbon's articles? The current board members would not need to "run" for their seats, the quetsion a recall poses is whether they should be recalled, if that vote is in the affirmative then the candidate scoring the highest number of votes wins the seat. If that answer is in the negative then the board member keeps their seat.
Last year a group of people obtained something like 1,500 signatures in a weekend and were as Mixie says treated like shit. Expect the same result.

The donations made to the library are not handled by library staff, but rather by the Treasurer of the Friends. It would be difficult, not impossible, for donations to go missing. Firstly, 99% of donations are in check form so they have to be deposited. All deposited and expenditures are recorded on a balance sheet (usually monthly) so someone would catch missing money fairly quickly.
And, commonsense is right. There are strict evidentiary rules. Evidence gathering and the chain of custody is easily challenged and any hint of impropriety may result in the evidence being thrown out of court. Often referred to as "fruit from the poisoned tree".
Typically these types of investigations are very focused on a specific target, event or actions. In this case the audit is a broad "investigation" looking for anything. The BOS has no real knowledge that anyone has done anything wrong. That is the part that should trouble tax payers most is that this is not an investigation INTO wrong doing, it is an investigation into the POSSIBILITY of wrong doing. In these difficult financial times, when services are being cut, employees are being laid off and hours are being cut the expenditure of tens of thousands of dollars on something that MAY be is completely irresponsible.

If it is going to be an action of futility, then how do we keep them from destroying the town? I don't want to be Don Quixote, but I certainly don't want to stand by and watch from the sidelines. Any suggestion on how to proceed or what we should do as responsible voters need to be discussed. I know there is a certainly element of caution.
I keep reading about retribution and fear of retaliation. Why does the BOS scare people? Are they that powerful? Seriously, they are voted into office, and unless I missed a memo, they work for US, the taxpayers of Wareham. It is our obligation to keep them focused on what we want, not what they want.
Maybe I am just living in Nirvana, but we control the situation, not them.

When the bos were going to fire John McAuliffe, a TA that many citizens and employees thought was doing a good job, a petition was signed. And what did the bos do with it? Toss it across the table. The voice of the populace was tossed out.
When a petition was signed supporting the state's ruling on the Wackinko street name issue, several of the names were read aloud in a scoffing voice, and that petition was tossed aside. Let the people be heard? Not in Wareham thank you.
When articles were put on a warrant that would have redefined the role of the bos in the charter what happened? Bos Donahue's spouse illegally closed town meeting before those articles could be heard. The "miscount" could easily have been rectified, but was not even though it was immediately pointed out. Even ragboy agrees with that one.
I certainly don't need to go through the list of firings in town. Are we any better off for this so called "cleaning house" that has been done? The town is in a state of chaos.
May I remind you of the computer audit? Talk about big brother.
This bos publicly call town employees "hurtful names" and publicly humiliate the ones they despise even though that has been denied by the bos. These things are on record. And if your name has been called, your days are numbered.
This bos let the town go for more than a year without a qualified town administrator. Is that serving the people? I think not.
This bos uses town counsel as their own--free of charge--lawyers. Our legal bills are taking away from town services.
People have run against what is called the Donahue machine in town. It has been alleged that the machine stoops so low as to steal the signs off the lawns of the opponent's supporters. And if you need proof that they can round up votes--let me remind you of the last water district meeting where John D. was ousted as moderator. Shortly thereafter, 13 more people entered the auditorium, voted to retain Donahue's allegedly incompetent sister/treasurer, and then they left before the next article which was to vote on a multi-million dollar budget.
So, you tell me. What are our chances? Short of a hurricane wiping Wareham off the map and starting over, we seem doomed at least until next April.

Isn't it time we put a stop to the political bully tactics? I guess the simple thought is that up until recently, most people just watched in horror. Now the detractors of the BOS is growing, so the real question is, can we take on the bullies? It probably as simple as how many people want to see change? If the number is sufficient, then who cares what they pull out of their hat?
It's a numbers game. Do we have more than they have? If we do, then let's prove it. If not, then we don't have a chance.
I don't mind taking the arrogance and bully tactics if we come out ahead in the end. If I have learned anything, it's important to have a majority. that is the key.

There are so many people that read this blog they may not be members but they read it and tell their friends. Out of all these people someone must know someone who is capable and has the time to become a selectman. There are a lot of smart people out there. I don't know a lot about Winslow but wouldn't she run again. Most of my friends and retired and are only here six months out of the year. There must be some younger, smart, caring people who would like to run for selectman.

According to Ms. Winslow's husband who attended a cookout I was at this weekend she has no intentions of another run at this point, however, he made it clear that they have not had much conversation about the long term future. He said that she is deeply touched by the e-mails and calls she is receiving and she is amazed by the support she received during the campaign.
While she was not at the cookout I would imagine that her husband has an idea of where her head is at. He did say that she has expressed this to a number of people and hopes we know she has made this decision for personal reasons and no other reason. I think he meant that she hasn't been scared away by all Bobo's claims of her being a secret CBW agent.
Her husband was very nice and I could tell that he would fully support whatever she decided to do.
On another note my friend mentioned that Ms. Winslow did apply recently to the Personnel Board but has received no response. Stunning. I would guess that the chances of the Fin Comm Chair, BOS Chair and Town Moderator appointing her are slim to none. I hope she isn't disappointed.
