After reviewing Director of Inspectional Services Myles Burke's credentials, the state Department of Public Safety has determined for a third time that Burke is not qualified to be an inspector.

Inspectors are required to obtain certification from the state Board of Building Regulation and Standards, per Massachusetts General Law.

Burke has twice appealed the decision of the state Building Official Certification Committee, which in September determined that he does not "meet the minimum qualifications" to be an inspector, and thus could not receive certification, according to documents obtained from the Department of Public Safety by way of a public records request.

The committee cited a lack of supervisory experience as the reason for its findings.

"Although your resume indicates that you have experience in construction, the Committee ascertains the information submitted on your resume did not include enough detail related to building construction or design to demonstrate that you meet or exceed the qualifications for the position of inspector of buildings," a September 9 letter from the committee, addressed to Burke, reads.

The letter indicated that Burke must request a public hearing "to appeal the decision to remain in the position of inspector of buildings for the Town of Wareham."

Burke appealed the decision, which led to an October 13 hearing with the committee. After the hearing, the committee still found that Burke did not meet the required qualifications, according to an October 22 letter from the committee to Burke.

Burke again appealed the committee's decision, and provided the committee with documentation from his work with the Lawrence Housing Authority, where he was employed for 15 years as a housing specialist. The committee determined on January 5, however, that the additional information provided "did not clearly indicate any supervisory experience," according to a letter dated January 14.

Burke has 45 days from the date of the letter to appeal the decision to the state Building Code Appeals Board.

Town Administrator Mark Andrews said that certification is actually not a requirement of the position of Director of Inspectional Services, and that Burke is seeking certification on his own.

"He has all the credentials to do his job. ... He oversees the department, he's not an inspector," Andrews said. When Burke visits buildings, “he'll make an assessment and then [Building Inspector] Andy [Williams] will follow up."

Andrews said the Inspectional Services Department has transformed in the months since Burke arrived in April.

“If I didn't have a Building Inspector, then yes, we'd have to find somebody, but we've transformed the department to become more efficient," Andrews said.

Andrews said he couldn't comment further on the personnel matter.

Burke and representatives from the state Board of Building Regulations and Standards could not immediately be reached for comment.

Burke's hiring came under criticism shortly after he was brought on board. In May, Selectman Cara Winslow expressed concern that he was hired at a rate of $75,000 per year, though the position was advertised at roughly $51,000 per year. Andrews responded to the concern by pointing out that the department would be taking on additional responsibilities.

The answer is simple, Liz: CRONYISM!!..cronyism is defined as partiality to a long-standing friends especially by appointing them to positions of authority, regardless of their qualifications..could it be any more evident than in this case?

We Pay This Guy More Tham 30k Than The Job Is Advertised For,give Me A Break ,also Andrews And And Our State Rep Went With Him To One Of The Certifation Meeting, Andrews Is Now Prepareing To Make Him Asst Ta , More Bullshit,andrews And The Miles Burke Have To Be Shown The Door  Selectman , Stop Covering Up For This Incompetence And What Andrews Is Saying Miles Burke  Makes A Visit To The Project And Andy Williams  Does The Final Inspection And We Hire Miles Burkes Girlfreind As  Head Life Guard And She Is Now Being Grommed To Be Head  Of The Recration Dept . Over the past five years, you have a litany of mis-steps, miscues & miscalculations by the people responsible for running the show.

Ceda  -  Rec dept. - library director  -  assessors  -  accountants  -  Council on aging  -  Town administrator  - planning  - police chief  -  Municipal maint. staffing  -  WPCF  -  and, of course... the building inspector.

Why? the BoS has had a fetish over getting people that they can control, rather than professionals who operate within the rules & requirements of their area of expertise. They have tried to reach for the lowest individual of any group expressing an interest in coming to the Town as an employee. They have endorsed and practiced a clear policy of cronyism in  lieu of setting professional standards and seeking out the MOST qualified individuals.

It needs to stop. The salary levels resulting from this misguided approach are not lower than those needed to be paid to build a professional level cadre of Town employees. The level of qualifications, experience and professional achievement of recent hires are substantially BELOW that which can be attained by switching to a policy of doing the right thing. Doing the Right Thing??? My, My: what a concept!

You can have a direct impact on this process. You need to vote in the upcoming election in April. You need to vote for people who will play it straight, and stop trying to slide by. You need to make your voice heard.

Or, you can look forward to more of the same. Much more.

Andrews ,miles And Pacheco Went To The State Certifiey Authroity Some Monthes Ago To Peddle There Influecence ,but It Was To No Avail ,they Told Him That This Had Been A Problem Since He Was In Lawrence And They Told Him Way Back Then That He Had A Problem ,yet Andrews Hires Him As A Figure Head With Andy Williams Doing The Inspecting.    We Have A Unquailfied Building Inspector, A One Day Police Chief A Town Planner Fixing To Leave ,a Edic Chief Who Quit And Has Not Been Replaced, We Have A Failed Town , And We Have Slager Who Knew About This Problem But Does The Cover Up For Jayne And Brenda And Andrews , He Is A First Rate Liar And Now He Is Bringing His Paper Back To Do Thr Dirty Work Of The Doahue Machine.

Andrews States That Cronan, A Convicted Felon, Stanley A One Day Police Chief Who Has No Building Expereince, And Bob Either Were On The Screening Coomitee And Miles Blew Them Away, Another Way To Say This These 3 individuals Were Handpicked By Andrews As As A Rubber Stamp ,Stanley Was Looking For A Job At A 150k Salery And He Would Do The Bidding Of Andrews ,c\Cronan Was A Corupt Indivudal And A Member Of Our Crooked Board Of Selectman And Mr Andrews You Said When You Hired Mr Burke You Said That As A Condition Of Employment He Would Have To Be Certifid By The State And Now You Say It Is No Big Deal

i agree with dan send andrews and mr burke back to lawrence ,the reason this all came to lite is that the state found out that miles burke was illegally signing off on building permits which he is not qualified to do ,if something happends to the builings he signed off on and some one is killed then wareham would be in serious jeopardy fora lawsuit, his asst should have signed off on these building permits ,so the question i have  what will hapen ti these illegal permits that miles signed off on,      to the members of the board of selectman you have a problem on your hands ,please now is not the time for another coverup.

On January 5. 2011, in accordance with 780 CMR R7, the Rules and Regulations for the Certification of Inspectors or Buildings, Building Commissioners and Local Inspectors, the Building Official Certification Committee (the BOCC) reviewed documentation received from the Lawrence Housing Authority, As the letter did not clearly indicate any supervisory experience 'in building construction or design the BOCC voted to uphold their previous decision that you do not 'you meet the minimum qualifications for said position as defined by Massachusetts General Law (MGL) C 143 § 3.

In accordance with 780 CMR R7.1.7.1 MJC 143 § 100, whoever is aggrieved by this decision may appeal to the Building Code Appeals Board within 45 days of the date of this notice:
